Terms and Conditions

General

These terms and conditions apply to all services of Bookares, a product of Kimamedia bv, registered with the Chamber of Commerce in Eindhoven, the Netherlands under number 94299528. Bookares provides online booking management services for rental businesses.

Service

Bookares provides rental owners the opportunity to present rental objects or time allocations via a booking system. Users remain responsible for the accuracy of their booking system information. Users indemnify Bookares against copyright violation claims, including photographic materials and/or text contributions provided by them.

Content and website rights

Bookares expressly reserves the right to modify the website's structure, functionality, and references without further user consent. The company may translate, omit, or adjust information deemed inaccurate or irrelevant.

Liability

Bookares assumes no liability for consequences from user-supplied information or service disruptions. Services are provided 'as is' and 'as available', with no guarantees regarding uninterrupted operation, accuracy, or error correction. Bookares bears no liability for direct or indirect damage from website information. Bookares attempts to connect parties but is never party to agreements between them. Users must resolve disputes independently and indemnify Bookares from claims arising from such disputes.

Account management

Bookares may refuse, modify, suspend, or delete accounts due to improper conduct or aggressive language toward staff. Account suspension occurs when cooperation becomes untenable due to an irreparable breach of trust or systematic non-compliance.

User responsibilities

Users maintain account security, provide accurate registration information, and cannot impersonate others. Profile photos must not violate copyrights or contain offensive material.

Pricing

Service price changes affect only future subscription periods, not active subscriptions. Online payment methods are mandatory and essential for automatic processing and fraud prevention.

Payment

First manual payment authorizes Bookares to implement SEPA direct debit for subsequent charges.

Cancellation

Thirty-day notice required before contract termination. Cancellation proceeds through account settings or email to info@bookares.com.

User limits

Maximum 10 users per booking system permitted.

Service modifications

Bookares may discontinue, modify, or add service features permanently or temporarily. Continued use constitutes acceptance.

Prohibited use

Service reproduction, duplication, copying, or resale without express written permission is forbidden. Users cannot engage in service-disrupting activities.

Prohibited activities

The service may not be used for cryptocurrency operations, explicit sexual content, gambling, illegal activities, hate speech, phishing, malware, copyright infringement, spam, or server-disrupting activities.

Content moderation

Bookares reserves discretion to review, filter, modify, or remove content and accounts. Services are accessed at user's own risk. Bookares may refuse or remove listings. Inaccurate, incomplete, or incorrect information may be reported for owner correction or removal.

Intellectual property

All rights to the Bookares software, design, and related materials belong to Kimamedia bv. Users receive only a right of use for the duration of their subscription.

Support

Technical support is provided on a best-effort basis, utilizing third-party hosting partners for infrastructure.

Modifications

Bookares reserves the right to modify these terms at any time. The most current version is always available on this page. Continued use after modification constitutes acceptance.

Applicable law

These terms are governed by Dutch law. Disputes shall be submitted to the competent court in Eindhoven.
